Kutjevo d.d. uses procedures and technology that best ensure your privacy. These Privacy Rules (hereinafter: Rules) describe which of your personal data we collect, how we process it, for what purpose, and your rights related to your personal data. The Rules comply with applicable legal regulations and Regulation (EU) 2016/679 on the protection of individuals regarding the processing of personal data.

We respect your privacy and process personal data fairly and lawfully, solely based on valid legal grounds, or in accordance with your consents for processing.

Methods and Purposes of Personal Data Processing
How and which personal data do we collect?

Depending on the legal basis, Kutjevo d.d. processes personal data such as: name and surname, email address, phone number, delivery address, IP address, and information about the device used to access our website.

When you access our website www.kutjevo.com, we collect and process certain data automatically sent by your browser to display our website and allow you to use it. This information is collected automatically each time you access our website and stored as logs on a server located in the cloud of Hetzner Online GmbH. These data do not relate to you personally but to your computer system and device used for access (such as IP address, access date and time, URL from which consent was given, anonymous, random, and encrypted key values, user consent country, etc.).

We collect and process your personal data based on the legal grounds and purposes outlined below:

Consent
Applies when you give consent for us to process your personal data for specified purposes:

  • When you consent to us and our partners (Facebook, Google Analytics, YouTube, MailerLite) placing and reading cookies and similar technologies on your device for:
    • Functional access to our website (functional cookies)
    • Providing relevant marketing content (marketing cookies)
    • Collecting statistical data (analytics/statistical cookies)
    • Enabling social media plugins (“social plugins”) on our website, allowing connection and data exchange with Facebook and Instagram
  • When you like our Facebook or Instagram page, leave comments, or send messages to communicate with us (we collect the data you provide during communication)
  • When you enter additional personal data to provide better delivery service (delivery address, phone number)
  • When you communicate with us via email to submit complaints or requests

You are not obliged to provide personal data based on this legal ground, but if you do not allow us to process your personal data, we may not be able to provide full access or the same quality of content on our website, or certain benefits.

Performance of a Contract
Applies when you provide personal data necessary to perform or prepare a contract, such as product sales and delivery:

  • When you place an order and provide personal data (name, age, email, phone number), and payment and delivery information, so we can properly deliver the ordered product. When registering on the Kutjevo webshop, we collect personal data (name, address, email, password, optionally phone number) and you accept the Kutjevo Club loyalty rules at https://www.kutjevo.com/kutjevo-klub. By accepting these rules, you become a member and agree to the terms of participation and benefits.
  • If you do not provide the required personal data, we cannot sell you our products.
  • When entering a contest or lottery and providing personal data (name, email, phone, address), we process it solely to conduct the contest.
  • When purchasing cellar bonds, providing payment and personal data (name, address, contact phone, email) allows us to deliver your ID card defining your wine’s position in Kutjevo’s wine vault and to contact you when the wine is ready for consumption. Additional data may be requested as defined by contest rules, and collected data will be deleted 120 days after winner announcement.

Legitimate Interests of the Company
Applies when we process personal data to pursue legitimate interests, e.g.,

  • Improving our website or products, preventing fraud, securing tools/systems
  • Providing general marketing content
  • Protecting our rights in case of breach of contract

If you do not want us to process your personal data on this basis, we recommend not using our website.

Compliance with Legal Obligations
Applies when processing personal data to meet legal obligations:

  • Issuing invoices after purchase/delivery, in compliance with legal regulations (tax, accounting, etc.)
  • Receiving and responding to complaints
  • Keeping consumer complaint records
  • Maintaining records of customers and cellar bond owners

Kutjevo d.d. ensures your personal data is protected from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. Security measures include physical, electronic, and procedural safeguards. Data is encrypted with SSL certificates.

Storage and Retention
Personal data is retained only as long as necessary to achieve the purpose, fulfill legal obligations, protect legitimate interests, or defend legal claims. Consumer complaints are retained 12 months; legal proceedings are retained until resolution. Data will be deleted after the retention period.

Transfer of Personal Data to Third Countries
Personal data may be transferred outside the EEA, always in accordance with EU GDPR standards.
